These terms govern use of the SKUHerderservice (“SKUHerder”, “we”, “us”), operated by SVI UK. By accessing or using the service you agree to these terms. They cover the SKUHerder software and its data-processing activities, including its use of official government APIs such as HMRC’s “Check a UK VAT number” service.

The service

SKUHerder is a business-to-business (B2B) market-intelligence and regulatory-compliance service for trade customers (brands, distributors and wholesalers). It compiles information about UK e-liquid and vaping retailers — including products, prices, stock levels and compliance indicators — from information those businesses publish and from official public registers.

Permitted use and restrictions

Subject to these terms and any subscription agreement, we grant you a non-exclusive, non-transferable right to access the service and use its outputs for your own internal business purposes. You must not:

• resell, redistribute or publish the underlying government registers or third-party datasets in bulk;
• operate a competing standalone lookup service (for example a standalone VAT-number-checking service) from our outputs;
• scrape, reverse-engineer or attempt to extract the service’s full dataset other than through provided means;
• use the service unlawfully or to infringe others’ rights.

Accuracy, data sources and no reliance

The service draws on publicly available information and official public registers (including Companies House, HMRC’s Check a UK VAT number API, and the UK WEEE producer register). We provide it on a best-effort, “as is” basis and do not warrant that it is complete, current or error-free.

Compliance indicators are signals, not legal advice or a determination, and a VAT verification reflects a point-in-time response from HMRC. You are responsible for your own decisions and should independently verify anything on which you intend to rely. Use of third-party data obtained via official APIs is also subject to those providers’ own terms of use.

Intellectual property

The SKUHerder software, its compiled datasets, scoring and presentation are our intellectual property or that of our licensors. No rights are granted except as expressly stated in these terms.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue or data, arising from use of the service. Nothing in these terms limits liability that cannot be limited by law. Our total liability is limited to the amount you have paid for the service in the twelve months preceding the event giving rise to the claim.

Privacy and personal data

Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

Suspension and termination

We may suspend or terminate access for breach of these terms or where required to protect the service or comply with the law. Provisions that by their nature should survive termination (including intellectual property, disclaimers and limitation of liability) will do so.

Changes and governing law

We may update these terms from time to time; the date above shows when they were last revised. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
